Terms of Service

These Terms of Service ("Terms") govern your access to and use of ClassEcho's website, applications, software platform, and related services (collectively, the "Platform"). By creating an account, accessing, or using ClassEcho, you agree to these Terms. If you are creating an account on behalf of a business, organization, or studio, you represent that you have the authority to bind that business or organization to these Terms.
1. About ClassEcho
ClassEcho provides software tools that allow fitness, wellness, and service-based businesses to manage their operations, including online bookings, class and appointment scheduling, membership management, customer management, staff management, payment processing integrations, email and SMS communications, and business reporting tools.
ClassEcho is a technology provider only. ClassEcho is not:
- A fitness studio
- A marketplace connecting customers with studios
- A party to agreements between studios and their members
- A payment processor or financial institution
Any relationship between a studio and its members exists solely between those parties.
2. Account creation and eligibility
To use ClassEcho, you must:
- Provide accurate and complete account information
- Maintain the security of your login credentials
- Keep your account information updated
- Use the Platform only for lawful business purposes
You must be at least 18 years old to create a studio owner account. Studio owners are responsible for all activity performed through their account, including activity by authorized staff members.
3. Studio responsibilities
Studios using ClassEcho are responsible for their own business operations and customer relationships. As a studio owner, you are responsible for:
Business information: ensuring your studio information, pricing, schedules, and services are accurate; maintaining accurate member records; and providing correct information to your customers.
Member relationships: you are solely responsible for membership agreements, refund policies, cancellation policies, class policies, customer disputes, and compliance with consumer protection laws.
Legal compliance: you are responsible for ensuring that your use of ClassEcho complies with applicable laws, including laws related to privacy, marketing communications, consumer protection, payment processing, and customer data collection.
4. Payments and billing
ClassEcho subscription fees: studio owners pay subscription fees to access the ClassEcho Platform according to the pricing plan selected during signup. Subscription fees are billed monthly or annually depending on the selected plan, may change from time to time with reasonable notice, and are separate from payments collected from studio members. ClassEcho does not charge a percentage of member transactions.
Member payments: payments made by studio members are processed through the studio's connected payment provider account, such as Stripe Connect. The studio remains responsible for payment processing compliance, refunds, chargebacks, taxes, customer disputes, and compliance with payment provider requirements. ClassEcho is not the merchant of record for member transactions and does not control the terms of transactions between studios and their members.
5. Free trials
ClassEcho may offer free trials or promotional periods. Trial availability, duration, and conditions may vary and will be displayed during signup. Before a trial converts into a paid subscription, we will provide reasonable notice where required. If payment information is required during signup, you authorize billing according to the selected subscription plan after the trial period ends unless you cancel before the conversion date.
6. Acceptable use
You agree not to use ClassEcho to:
- Violate any applicable law or regulation
- Upload illegal, harmful, or unauthorized content
- Send spam, fraudulent messages, or unsolicited communications
- Access another studio's data without authorization
- Attempt to bypass security measures
- Reverse engineer, copy, or modify the Platform
- Interfere with the operation, security, or availability of ClassEcho
We reserve the right to investigate suspected misuse.
7. Your data
You retain ownership of the information and content you submit to ClassEcho, including studio information, branding assets, member information, and business data. You grant ClassEcho permission to process this information only as necessary to provide and operate the Platform. Studio owners may export their business data subject to available export features.
When you close your account, ClassEcho may delete your data within a reasonable period, except where retention is required for:
- Legal obligations
- Accounting purposes
- Security purposes
- Resolving disputes
8. Data protection and privacy
Your use of ClassEcho is also subject to our Privacy Policy. Studios remain responsible for ensuring they have the necessary rights and permissions to collect and manage member information through the Platform. ClassEcho applies reasonable security measures to protect information stored within the Platform.
9. Third-party services
ClassEcho may integrate with third-party services, including payment processors, email providers, authentication providers, and other software integrations. Third-party services operate under their own terms and privacy policies.
ClassEcho is not responsible for the availability, security, or practices of third-party services.
10. Intellectual property
ClassEcho owns all rights, title, and interest in the Platform software, Platform features, website content, branding, and technology infrastructure. You may not copy, modify, distribute, sell, or reverse engineer any part of the Platform without written permission.
You retain ownership of:
- Your studio branding
- Your uploaded content
- Your member data
11. Service availability
We work to keep ClassEcho reliable and available but cannot guarantee that the Platform will always be uninterrupted or error-free. The Platform may occasionally be unavailable due to:
- Maintenance
- Updates
- Technical issues
- Third-party service interruptions
We are not responsible for losses resulting from temporary service interruptions.
12. Account suspension and termination
You may cancel your ClassEcho account at any time. ClassEcho may suspend or terminate accounts if:
- These Terms are violated
- The Platform is used unlawfully
- Security risks are identified
- Payments are overdue
Where reasonably possible, we will provide notice before termination.
13. Disclaimer of warranties
ClassEcho is provided on an "as available" and "as is" basis. To the maximum extent permitted by applicable law, ClassEcho makes no warranties regarding continuous availability, error-free operation, specific business results, or compatibility with all third-party services.
14. Limitation of liability
To the maximum extent permitted by law, ClassEcho will not be liable for indirect damages, lost profits, loss of business opportunities, loss of data, or consequential damages.
Our total liability for any claim related to the Platform is limited to the amount paid by you to ClassEcho during the twelve (12) months before the event giving rise to the claim.
15. Governing law
These Terms are governed by the laws of the Province of Quebec and the applicable federal laws of Canada. Any disputes arising from these Terms will be subject to the courts located in Quebec, Canada.
16. Changes to these Terms
We may update these Terms from time to time to reflect changes to our services, legal requirements, or business practices. If we make significant changes, we will provide reasonable notice to account owners before the changes take effect.
